Online Sellers: FedEx Shipping Class Action Lawsuit Filed (October 2021)

Approximately two weeks ago a man from Hawaii named Siala Taito filed a Class Action Lawsuit against FedEx for "breach of contract" due to FedEx's failure to deliver a package on time and refusal to refund the amount paid for the service. Now this is where things get really interesting, according to the lawsuit, "The lead plaintiff, Mr. Taito, says he sent a package via FedEx Express Priority Overnight shipping in July 2021. Taito claims his purchase totaling more than $500 was not delivered the following day and was, in fact, delivered two days late. FedEx has failed to refund any of the amount he paid." Now if you are an avid reader of our blog you probably saw our post called Why We Stopped Offering Overnight or Next Day Delivery, and in this post we outlined EXACTLY what Mr. Taito is complaining about, even though we ship through USPS, not FedEx. It appears the carriers, in general, are unable to provide the service they are offering. In fact, according to research, FedEx only makes 71 percent of its Express deliveries on time, which means approximately 1-out-of-every-three FedEx Express deliveries do NOT arrive next day. This data was included in court documents relating to this Class Action Lawsuit.
If you have a FedEx account you may be wondering why Mr. Siala did not get a refund and the reason is that he shipped these parcels at a FedEx store, without using his account. Therefore when the packages did not arrive on time Mr. Siala was unaware that he was only allotted 15 total days from the actual delivery date to file his refund claim.
