eCommerce: Abandoned Cart TEXT MESSAGE Lawsuit (Interesting Class Action!)

As an online shopper I’m sure you have received “Abandoned Cart” emails that look something like this:
People who shop online or from their phones often leave something in their online “shopping cart” to come back to later. If a person starts the checkout process but doesn’t finish it, then this is considered an “abandoned cart”. Most companies have follow up with shoppers who leave unpurchased items in their carts by sending them an email like the one shown above. 20% of the time, sending this email get’s the person to come back to the web retailers site and buy the item, so you can see just how valuable Abandoned Cart emails are. However, some companies are violating the TCPA (Telephone Consumer Protection Act) law by sending text messages that the potential buyer did not agree to. (<--- keywords, “Agree to”). Specifically buyers are stating that Walmart, Amazon, Zulily, JC Penny and eBay are exceptionally guilty of this violation however there are other companies who have also been busted.

On that note, if you did agree to receive text messages from a company and you no longer want to receive the text messages, you should be able to reply "STOP" or "END" to the message and it should remove you from the list.... unless it's political text messages. I have been trying to unsubscribe from those darn things for a year without success :(
